It can be difficult
to assess whether one mediator is any better than another, so we have
compiled some points that will help you decide whether you chosen
mediator is the best for your situation.
Experience to look for:
A service that specialises
solely in mediation.
A mediator who has reached the Legal
Services Commission quality standard of being competent to handle all
mediations and, in particular, those where Legal Aid competency has
been achieved.
Private clients can be seen after only 10 hours of experience. Legal
Service commission competency is attained only after a year's mediation
work minimum (usually after more than 100 hours of mediation).
If a case has a difficult emotional
feature/s, then the mediator should have several years experience of
providing emotional help. Indications of competence in this field would
be if the mediator had counselling /psychotherapeutic training and had
experience of delivering counselling/therapy.
If a case has a difficult legal element,
then the mediator should have several years of legal experience,
including advocacy in court.
If a case has both difficult emotional
and legal features and elements, it would be helpful to consider
placing such a matter with a mediator who has, say, 10 years experience
as a family mediator and who has also trained and acted as a PPC (a
Professional Practice Consultant).
There are estimated to be about 70-80 such family mediators throughout
the UK
who have reached that level of competency.
A service where the professional mediator
is not involved any longer in court litigation. The reason is
that the day-to-day thinking of the mediator is arguably best able to
help in mediation if the mediator is mainly thinking about settling
matters through pointing out options and helping clients to adjust from
demands to compromise, bearing in mind, in particular, the interests of
any children, rather than thinking of their the parents' interests and
agenda.
Naturally a mediator is likely to be able
to deliver a very good standard of family mediation having worked
solely as a family mediator for 10 years and been used to carrying out
an average of in excess of 100 hours actual family mediation every year
ie has completed 1000 hours mediation.
